Abstract

This scientific article proposes an in-depth analysis of urbanity in the practice of law, not merely as a rule of social etiquette, but as an essential ethical-legal imperative for the administration of justice and procedural speed. Through a bibliographic and documentary review, the concept of urbanity is investigated in light of the Statute of Advocacy and the OAB (Law No. 8.906/94) and the Code of Ethics and Discipline, contrasting theory with the conflicting reality of forums and courts. The study addresses the legal nature of the duty of courtesy, the absence of hierarchy between lawyers, magistrates, and members of the Public Prosecutor's Office, and the direct impact of aggressive litigation on judicial delays and the mental health of legal practitioners. Ideally, the institutional role of the OAB Commissions in mediating interprofessional conflicts and promoting a culture of mutual respect is highlighted. It is concluded that civility is an indispensable technical tool for the effectiveness of judicial protection and that strengthening ethical control instances is vital for the preservation of the Democratic Rule of Law.
