Legal Aspects and Consequences of the Constitutional Division of Powers Regarding the Regulation of Longitudinal Waterway Transport in Amazonas

This article addresses the legal and consequential aspects of the constitutional division of powers in regulating longitudinal waterway transport in Amazonas. The Federal Constitution of 1988 assigns the Union responsibility for operating waterway transport services that cross state borders or are located within border zones. However, regulating waterway transport within states and municipalities presents unique challenges, requiring effective coordination among federal entities. The study analyzes state norms and laws, with a focus on Law No. 5,604/2021 and State Decree No. 45,110/2022. It concludes that harmonizing regulations and fostering cooperation among regulatory agencies is essential for promoting safe, efficient, and integrated waterway transport, meeting the needs of the population, and contributing to the sustainable development of the Amazon region.
