The terrorist threat has become present throughout the globe. Previously confined to certain corners of the world, it is now present and relevant in the policies of various countries, not only as a national threat but also transcending the borders of sovereign states and affecting all human and state relations. Therefore, this article aims to analyze the definition of terrorism conferred by Law No. 13.260/2016 and whether the same criterion is used internationally, as well as whether a possible incident in Brazil could be framed not only by its legal definition but also by the definitions set forth in international treaties to which the country is a signatory. The methodology used was qualitative, highlighting bibliographic research and literature review. The article is structured by understanding the phenomenon of terrorism, followed by the national definition of terrorism, analyses of treaties on the subject to which Brazil is a signatory, the confluence of the national model in the context of conventionality control, followed by final considerations.
